TRADEMARK PROTECTION

A trademark is a distinctive sign used to identify products or services and to distinguish its products or services from those of other entities. A trademark is can be a name, word, phrase, logo, symbol, design, image, or a combination of these elements. Non-conventional trademarks include color, smell, or sound. A registered trademark confers exclusive rights to the trademark owner, including the right to exclusive use of the mark in relation to the products or services for which it is registered.

Registered trademark must be maintained through actual use of the trademark because these rights will cease if a mark is not actively used for a period of time. A registered trademark can last forever providing the mark is used and renewal fees are paid annually.
